Yes. Foreigners can legally own property in Baja California Sur through a fideicomiso (bank trust) or via a Mexican corporation. Most residential buyers use the fideicomiso, which gives you all the same rights as ownership in your home country, including selling, leasing, or passing the property to heirs.
A fideicomiso is a 50-year renewable bank trust that holds title on your behalf. It’s required for foreigners buying within 50 km of the coastline (the “Restricted Zone”), which covers all of the East Cape. The bank acts as the trustee, but you remain the legal beneficiary with full control over the property.
The process here is handled by a notario público (government-appointed attorney), who verifies title, manages closing, and records the transaction. There’s typically no title company, and cash offers are more common, though owner financing is sometimes available.
Closing costs in Baja usually range from 5 to 8% of the purchase price, covering aquisition tax, closing attorney fees, notario fees, bank trust setup/transfer, and government registration. Buyers typically cover their own closing costs, though this can sometimes be negotiated.

Yes—property taxes (predial) are very low compared to the U.S. or Canada. Annual rates are typically between 0.1% and 0.2% of the property’s assessed value, which often amounts to just a few hundred U.S. dollars per year.
Most areas in the East Cape allow vacation rentals, but some HOA communities have specific rules. You’ll also need to register with Mexico’s tax authority (SAT) to pay income tax on rental earnings.
